TERMS OF USE OF DATASETS

Access to the datasets that València City Council publishes on this Open Data portal implies acceptance of these Terms of Use, the purpose of which is to protect and promote the commitment that València City Council has to the reuse of public sector information, allowing the recipients of the datasets to contribute to the growth of the community by contributing the benefits obtained from the exploitation of the same.

These general conditions are binding on any person and/or company that reuses data by the mere fact of making use of the documents subject to them.

LICENSE APPLICABLE TO DATASETS

The general method of making available all the datasets offered by the City Council of Valencia will be that established in article 4.2 paragraph a) of Law 37/2007, of 16 November, on the re-use of public sector information: "Re-use of documents made available to the public without being subject to conditions".

The concept of document is that established in section 2 of article 3 of Law 37/2007, of 16 November, on the Re-use of Public Sector Information, and therefore includes all information whatever its material or electronic support as well as its form of graphic, sound or image expression used, also including the data in its disaggregated or raw levels.

Thus, unless otherwise stated, the datasets are published under the terms of the Creative Commons Attribution - Attribution License (CC-BY 4.0) and allow their reuse so that they can be used for the following purposes:

Copy, distribute and publicly disseminate.
Serve as a basis for derivative works as a result of their analysis or study.
Use for commercial or non-commercial purposes.
Modify, transform and adapt, making these changes public.

It is also prohibited that in the course of re-use of the datasets the meaning of the information provided by the datasets may be distorted or misrepresented.

Acceptance of these Terms of Use does not constitute a grant of copyright or intellectual property rights in the datasets.

In the case of information anonymised for personal data protection or other reasons, it is expressly forbidden to re-identify persons on the basis of this data and other possible, past, present or future sources of data and information.

Valencia City Council reserves the right to publish datasets whose access, use or reuse may be subject to the payment of a fee or financial consideration. The amount of these fees or considerations will be aimed at covering the costs associated with the production, reproduction and dissemination of the datasets, and may not, in any case, be higher than these costs. The list with the amount of the applicable fees or charges shall be published together with the datasets subject to this circumstance.

ACKNOWLEDGEMENT

The use, reproduction, modification or distribution of the datasets implies, under the terms of the Creative Commons - Attribution (CC-BY 4.0) licence, the obligation to acknowledge/cite València City Council as the source of the datasets as follows:

CHANGES TO DATASETS AND TERMS OF USE

The City Council of Valencia may add, delete or modify the published data sets or these Terms of Use at any time. Notice of such changes will be published on http://www.valencia.es/dadesobertes. Any changes made will be effective from the time of publication unless otherwise notified.

Any modification or transformation carried out on the datasets published by the City Council of Valencia must be identified as such at the time of distribution.

All persons, natural or legal, who use, reproduce, modify or distribute the datasets are urged to inform the City Council of Valencia of all projects related to or derived from the use of the datasets, so that they can be publicly exposed in order to stimulate the policies of re-use of public sector information.

GUARANTEE OF DATASETS

The València City Council will endeavour to ensure the timely updating, availability, completeness, integrity and quality of the published datasets, although it cannot fully guarantee this despite efforts to manage these datasets appropriately.

Any person, whether natural or legal, who uses the datasets published by the City Council of Valencia will be treated as a reusing agent, and as such must accept the datasets as they are and use them at their own risk. They will also undertake to inform the València City Council if they detect any defect or error in the published data.

EXCLUSION OF LIABILITY

The person, natural or legal, who uses, reproduces, modifies or distributes the datasets accepts, by means of these Terms of Use, not to take legal action against the València City Council as a consequence of any action that the València City Council may carry out, whether deliberately, involuntarily or negligently, in relation to the datasets. This means that both the València City Council and any of its agents are not responsible for any damage or loss caused by the use of the published datasets directly or indirectly, including those resulting in economic, material or data damages.

LIABILITY FOR NON-COMPLIANCE WITH THE TERMS OF USE

The reusing agent is subject to the regulations applicable to the reuse of public sector information, including the sanctioning regime set out in article 11 of Law 37/2007, of 16 November, on the reuse of public sector information. If as a result of non-compliance with the Terms of Use set out in this document, or the terms of the licence under which the datasets are published, the València City Council is subject to legal action or is financially penalised, the individual or legal entity that uses, reproduces, modifies or distributes the datasets agrees to defend the València City Council and to pay the corresponding financial penalty.

In this way the person, natural or legal, who uses, reproduces, modifies or distributes the data sets agrees to defend, indemnify and hold harmless the València City Council and all its agents from any liability that may be incurred due to claims that may arise with respect to the breach of these Terms of Use.

The València City Council, for its part, reserves the right to take the corresponding legal measures to protect its interests, without this implying the waiver of the defence and compensation by the person, natural or legal, who uses, reproduces, modifies or distributes the datasets.

CANCELLATION FOR NON-COMPLIANCE

The València City Council may, at its own expense, cancel or suspend access to the datasets without prior notice or without any reason, including any that the València City Council, at its own discretion, considers to involve a breach of these Terms of Use or to be otherwise unlawful or harmful to third parties. In the event of cancellation or suspension, the person, whether natural or legal, will no longer be authorised to use or reproduce the data sets and, furthermore, the City Council of Valencia may use any means at its disposal to make its decision effective.

Such deletion or suspension shall have no effect on persons, natural or legal, who are in compliance with these Terms of Use even if they have received the data sets through a sanctioned person, natural or legal.

UNSUPPORTED

It may not publicly indicate, insinuate or suggest that the València City Council participates in, sponsors or supports the specific use or reproduction that any individual or legal entity makes of the datasets.
